Make Work Pay: Call for evidence on Transfer of Undertakings (Protection of Employment) Regulations

Trade union officials and workplace reps have extensive experience of representing members during TUPE transfers, both through information and consultation arrangements and by ensuring that members benefit from their TUPE-related rights. However, the TUC believes that the regulations, as they currently stand, fail to protect workers’ key rights, as they transfer to another employer.

Threshold for triggering collective redundancy obligations - TUC response

The TUC strongly welcomes the policy intent behind these measures: to reform the collective redundancy process to enable wider consultation with affected employees. However, we urge the government to consider a far more ambitious second threshold test for collective consultation to ensure that more workers benefit from a collective voice during a redundancy process and that there is more than a token change in the number of consultations taking place.

Make Work Pay: Consultation on improving access to flexible working

The provisions in the Employment Rights Act are welcome, and our response provides a trade union view on how to ensure the duty to consult process is robust, fair and consistent. We also believe that legislative change needs to go further if we are to ensure that flexible working is the default for all workers.
