The TUC will be considering the detail carefully and working with affiliated unions to understand the implications of this code, but we are concerned it does not address the significant issues we have raised about the practical application of the Supreme Court judgement in April 2025. The guidance fails to provide the clarity needed to ensure all workers are treated with dignity and respect at work
There is a clear need for an Employment Code of Practice that provides practical guidance to employers and meaningful protections for all workers.
The TUC has been clear: all workers including trans and non-binary workers have the right to safety, dignity and full participation in working life and any code of practice should support this.
Dignity at work is not a limited resource. Women’s rights to safety, respect and equality are fundamental – and so are the rights of trans people.
The struggle for equality and the struggle for workers’ rights has never been separate, they are part of the same fight against exploitation, inequality and injustice. The law and workplace practice must work for everyone.
We must build a world in which trans lives are not only legally recognised, but fully liveable in practice – including self-declaration, rooted in the commitments TUC Congress has returned time and again.
